- Customer-Directed Data Backup
You, the Customer, are responsible for providing specific instructions on which data and files you wish to have backed up by XOTIC PC. Only the data explicitly identified by you will be backed up. It is your responsibility to ensure that these instructions are accurate, complete, and up to date. - Acknowledgment of Risks
You acknowledge and understand that the process of backing up data involves inherent risks, including but not limited to data loss, corruption, or incomplete backups. XOTIC PC will take reasonable measures to back up your data as per your instructions but cannot guarantee that all data will be successfully backed up without errors. - Limitation of Liability
By using our data backup services, you release and hold harmless XOTIC PC, its employees, affiliates, and partners from any and all claims, damages, or losses arising out of or related to the data backup process. This includes, but is not limited to, any loss, corruption, or inability to retrieve backed-up data, except in cases of gross negligence or willful misconduct on the part of XOTIC PC - Customer Responsibility
It is your responsibility to ensure that the data specified for backup is correct and complete. XOTIC PC will not be liable for any data that is not backed up due to incomplete or inaccurate instructions provided by you. - No Warranty
XOTIC PC provides data backup services "as is" without any warranties, express or implied. We do not guarantee the success or completeness of the backup process and recommend that you maintain additional backup copies of your important data. - Governing Law
This release is governed by and construed in accordance with the laws of the state of Nebraska, without regard to its conflict of laws principles.
